1. Acceptance and scope
These Terms of Service (the “Terms”) are an agreement between you and the operator of Sweep identified in the applicable Promotion Details (the “Operator,” “Sweep,” “we,” “us,”or “our”). By accessing or using the Sweep website, applications, smart contracts, or related services (collectively, the “Service”), you agree to these Terms.
Each product promotion may also have promotion-specific details and is subject to the Official Rules. If these Terms conflict with the Official Rules or the details displayed for a particular promotion, the Official Rules and then the promotion-specific details control for that promotion.
If you do not agree, do not use the Service. You may not use the Service on behalf of another person unless you are legally authorized to bind that person and the use is permitted by the applicable rules.
2. Eligibility and accounts
You may use Sweep only if you can form a binding contract, meet the age and location requirements shown in the Official Rules and the applicable promotion, and are not prohibited from participating by law. Promotions are void where prohibited.
You must provide accurate, current information and maintain control of your login credentials and connected or embedded wallet. You are responsible for activity authorized through your account or wallet. Tell us promptly through the support channel published in the Service if you believe either has been compromised.
3. How Sweep works
Sweep offers time-limited promotions for physical and digital products. Each promotion page identifies the prize, entry period, number or target of paid entries, delivery type, and other material details. One eligible entry is selected as the winner.
The Service currently uses Polygon smart contracts to record paid entries, market status, draw results, refunds, and prize settlement. Some display information—such as product descriptions, photographs, and estimated retail values—may be maintained off-chain.
Product names such as “market,” “lot,” or “share” are interface labels only. An entry is a chance to win a prize. It is not equity, debt, an investment contract, or an ownership interest in Sweep or the prize.
4. SWEEP tickets and payments
SWEEP tickets are platform credit, not an investment. One SWEEP ticket is used as one U.S. dollar of entry credit within the Service. You may fund a balance through the payment options made available by Sweep. Payment processing is handled by third-party providers such as Stripe; Sweep does not receive your full payment-card number.
SWEEP does not earn interest and is not a bank deposit, security, or government-backed currency. It may be used, refunded, or issued for a prize sell-back only as expressly described in the Service, these Terms, or applicable law. Sweep does not promise that SWEEP can be exchanged for cash or used outside the Service.
Funding is credited after the payment provider confirms payment. Payment delays, reversals, chargebacks, or suspected fraud may delay credits or result in account restrictions and reversal of improperly credited amounts, to the extent permitted by law.
5. Entries and transactions
A paid entry currently costs one SWEEP. When you confirm a purchase, your wallet authorizes a transaction that transfers the applicable SWEEP to the promotion’s smart-contract escrow and records your entries. Entry balances are non-transferable and cannot be resold.
A transaction is complete only after it is accepted and confirmed by the relevant network. A rejected or reverted transaction does not create an entry. Network fees, if any, are separate from the entry price and may be outside Sweep’s control.
Entries are final once accepted except when a promotion expires unfilled, is cancelled, or a refund is otherwise required by the Official Rules or law. Limits may apply per person, account, wallet, household, or promotion and must apply equally across entry methods.
6. Draws, refunds, and cancellations
Under the current smart-contract flow, a promotion that reaches its paid-entry target moves to drawing immediately. Chainlink VRF supplies a random value, and the smart contract maps that value to one entry. Each eligible entry included in the draw has an equal chance of being selected.
A promotion that reaches its end time without filling may expire without a draw. An open or drawing promotion may also be cancelled if the draw cannot be completed, the promotion cannot lawfully proceed, or another circumstance described in the Official Rules applies. Paid entries in an expired or cancelled promotion are returned in SWEEP to the wallet that entered. On-chain refunds may be processed in batches and may not appear instantly.
Once a valid draw resolves, entries are not refundable merely because an entrant did not win. The promotion page and blockchain record show the controlling status of a promotion, subject to correction where required by law.
7. Prizes and winner choices
A winner must follow the claim instructions and provide information reasonably needed to confirm eligibility, handle taxes, and deliver the prize. Physical prizes require a deliverable address; digital prizes are delivered electronically. A winner may be responsible for costs or taxes not expressly included in the promotion details.
The current Service also allows a winner to irrevocably sell a prize back for SWEEP. The displayed sell-back amount is 95% of the product’s recorded landed cost (product cost, shipping, and tax), not 95% of the total entries collected. Choosing delivery or sell-back is final once the blockchain transaction confirms.
A prize left entirely unclaimed may be forfeited after 30 days from the recorded draw resolution, subject to the Official Rules and applicable law. If a listed product becomes unavailable, Sweep will apply the promotion-specific rules and applicable law; the current smart contract does not itself reverse a resolved draw.
8. Wallet and blockchain risks
Blockchain transactions are generally public and irreversible. Sweep cannot recover a wallet, reverse a transaction, or change a public record solely because you lost credentials, used the wrong wallet, or misunderstood a wallet prompt. Review transaction details before signing.
Networks, wallets, RPC providers, oracles, and smart contracts may experience congestion, outages, bugs, delayed finality, forks, or other failures. Sweep may pause an interface or cancel a promotion where permitted by the Official Rules, but cannot guarantee continuous operation of third-party infrastructure.
9. Acceptable use
You must not:
- violate law, sanctions, or the rules of a promotion;
- create duplicate or misleading identities, evade entry limits, use bots, collude, or manipulate entries or draws;
- interfere with the Service, probe for vulnerabilities without authorization, introduce malicious code, or overload infrastructure;
- use another person’s account, payment method, wallet, or personal information without permission; or
- copy, scrape, sell, or commercially exploit the Service except as permitted by law or written authorization.
We may investigate suspected abuse, reject invalid entries, restrict access, and preserve relevant records, subject to the Official Rules and applicable law.
10. Third-party services and content
The Service relies on providers for identity and wallets, payment processing, blockchain access, randomness, hosting, communications, and prize fulfilment. Their own terms and privacy practices may apply. Sweep is not responsible for a third party’s separate service, but this does not limit obligations Sweep cannot lawfully disclaim.
Product and brand names belong to their respective owners. Unless a promotion expressly says otherwise, displaying a product does not mean its manufacturer or retailer sponsors or endorses Sweep.
11. Service disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Sweep does not warrant uninterrupted or error-free access, that every display will be current at every moment, or that third-party networks and services will operate without delay.
Nothing in these Terms excludes warranties, refund rights, or other protections that cannot be excluded under applicable law. Additional product-specific cautions appear in the Disclaimers.
12. Limits on liability
To the fullest extent permitted by law, Sweep and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss caused by events outside reasonable control. These limits do not apply where liability cannot lawfully be limited or excluded.
13. Changes and termination
We may update the Service or these Terms prospectively. Material changes will be communicated as required by law and will not alter the rules of an already-open promotion unless the applicable rules and law permit it. Continued use after updated Terms become effective means you accept them.
You may stop using Sweep at any time. We may suspend or terminate access for rule violations, fraud, security risk, or legal necessity. Provisions that by their nature should survive—such as ownership, disclaimers, liability limits, and dispute terms—survive termination.
14. Governing law and disputes
These Terms are governed by the law applicable to the Operator and your use of the Service, without depriving you of mandatory protections available where you live. Before filing a formal claim, you and Sweep agree to make a reasonable good-faith effort to resolve the issue through the support channel published in the Service. Any unresolved dispute may be brought in a court with lawful jurisdiction.
15. Contact
Questions about these Terms may be sent through the support channel published in the Service.
